What Are the Legal Requirements for Landlords in Chester?

Landlords in Chester are subject to national requirements for England and Wales, plus local licensing schemes operated by Cheshire West and Chester Council. Non-compliance can result in fines, prosecution, and the loss of the right to recover possession of your property.

Legal Requirements — Every Rental Property in England

Gas Safety Certificate (CP12)

Annual

Required annually for every property with a gas supply. Must be carried out by a Gas Safe registered engineer. A copy must be provided to tenants before they move in and within 28 days of each annual renewal.

Electrical Installation Condition Report (EICR)

Every 5 years

Required every five years, or on a change of tenancy. Must be carried out by a qualified electrician. A copy must be provided to tenants before move-in and to any prospective tenant within 28 days of a written request.

Energy Performance Certificate (EPC)

Every 10 years

Properties must have a minimum EPC rating of E to be legally let. From April 2025, a minimum rating of C is proposed for new tenancies. An EPC is valid for 10 years. Landlords cannot legally let a property with an F or G rating.

Smoke Alarms

Required

At least one working smoke alarm must be installed on every floor of the property. Alarms must be tested on the first day of every tenancy. Failure to comply can result in a civil penalty of up to £5,000.

Carbon Monoxide (CO) Alarms

Required

A CO alarm is required in any room containing a fixed combustion appliance (boiler, gas fire, wood burner). Since October 2022, this requirement also applies to all rooms with a fixed combustion appliance, not just solid fuel appliances.

Right to Rent Check

Before move-in

Landlords must verify that all adult occupants have the legal right to rent in England before the tenancy begins. Failure to carry out checks can result in a civil penalty of up to £20,000 per occupant, or criminal prosecution.

Tenancy Deposit Protection

Within 30 days

Deposits must be registered with a government-approved scheme (DPS, MyDeposits, or TDS) within 30 days of receipt. Prescribed information about the scheme must also be provided to the tenant within 30 days. Failure to protect a deposit can result in a penalty of 1–3 times the deposit amount.

How to Rent Guide

At tenancy start

The current version of the government's How to Rent guide must be provided to tenants at the start of each tenancy. If the guide is updated during a tenancy, the new version must be provided at renewal. Failure to provide the guide prevents landlords from serving a valid Section 21 notice.

Section 48 Notice

Required

Landlords must provide tenants with a written notice of the landlord's name and address (or the agent's address for service of notices). This is a legal requirement under the Landlord and Tenant Act 1987.

HMO Licensing in Chester

A House in Multiple Occupation (HMO) is a property occupied by five or more people from two or more separate households. These properties require a mandatory HMO licence from Cheshire West and Chester Council before they can be legally let.

Smaller HMOs (three or four people from two or more households) may also require a licence under the council's additional licensing scheme. Operating an unlicensed HMO is a criminal offence and can result in an unlimited fine, a rent repayment order, and a banning order preventing you from letting property.

Selective Licensing in Chester

Cheshire West and Chester Council operates selective licensing schemes in certain areas of Chester. Under a selective licensing scheme, all privately rented properties in the designated area — not just HMOs — require a licence from the council.
